Trademarks Services offered

Registration of International and Guyana Trade Marks, Searches, Name Reservation at the Intellectual Property Office, Renewals, Assignments, Change of Names & Addresses, Oppositions, Court proceedings for Infringement of Trademarks and Passing off of goods.

Trademarks can be registered in Part A of the Guyana TM Register in respect of goods in Classes 1 to 34. And for services in Classes 35-45 in Part C only if they are registered in the United Kingdom and a certificate issued by the United Kingdom Patent Office. UK trademarks in other Classes for goods may also be re-registered.

Trademark Filing Requirements

For International (incl. Guyana) applications the following is required:

  1. Name and address of the company or person registering the Trademark
  2. Name of the Trademark or logo
  3. 7 prints of the Trademark - device or word
  4. Classes 1-34 and specification of goods
  5. Authorisation to Agent in Guyana (Power of Attorney) in special format with original signature and stamp of Applicant (notarisation and legalisation not required)
  6. Translation, if applicable.

For United Kingdom based applications the following is required:

  1. Certified colour copy of the UK Certificate of Registration or certified true entry from the UK register of trademarks of the Comptroller General of the UK Patent Office.
  2. 7 prints of the Trademark - device or word
  3. Authorisation to Agent in Guyana (Power of Attorney) in special format with original signature and stamp of Applicant (notarisation and legalisation not required)


After filing an application to register a Trademark, a number is issued. The application is processed for advertisement and publication in the Official Gazette of Guyana inviting oppositions. If there are no oppositions, the Trademark can be placed on the Trademark Register.

Trademark Certificate - Length of time to issue

Part A of the TM Register - From filing date to obtaining the Trademark Certificate, once unopposed, now takes about 2 months.

Part C of the TM Register - 2 months.

The basic cost to register a Trademark is US$300.

 

To Renew a Trademark, the following is required:

  1. A Copy of the Trademark Certificate
  2. An Original Authorisation to Agent in Guyana (Power of Attorney) in special format (notarisation and legalisation not required) ONLY if the renewal is being done by an agent who did not register the Trademark in Guyana.
  3. It takes about 2 weeks for the Certificate of Renewal to be issued by the Registrar.

To Assign a Trademark, the following is required:

  1. A Notarised Assignment Agreement
  2. An Original Authorisation to Agent in Guyana (Power of Attorney) in special format (notarisation and legalisation not required).
  3. It takes about 2 weeks for the Certificate of Subsequent Proprietor to be issued by the Registrar.
