Probates

Probate is the legal process that takes place after someone dies testate, that is, leaving a Will. It involves the judicial determination of whether a Will is valid and the process of settling or administering an estate. The Executor or Executrix named in the Will is in charge of the process and must list and obtain a valuation of the assets of the deceased person, pay debts, taxes and estate expenses and distribute assets to the beneficiaries according to the instructions in the Will.

Letters of Administration with Will annexed

This grant of representation is obtained where a person dies leaving a Will, but did not apoint a personal representative or Executor or where the Executor named in the Will is for some reason unwilling or unable to Act or is out of Guyana.

Letters of Administration is the legal process that takes place after someone dies intestate, that is, without leaving a Will. The High Court appoints an Administrator or Administratrix to settle the estate.The Court may appoint relatives of the deceased in order of their entitlement to the property of the estate. That person is in charge of the process and must list and obtain a valuation of the assets of the deceased person, pay debts, taxes and estate expenses and distribute assets.

The documents required in applying for Probate include:

  • Original Last Will and Testament
  • Original or certified copy of Death Certificate
  • List of assets and liabilities (title documents)
  • Certificate of Valuation (immovable property and vehicles) from the Govt Chief Valuation Officer
  • Oath of Executor/ix
  • *Certificate (Estate Duty) of Proper Officer from the Guyana Revenue Authority
  • Affidavit of one attesting witness of Will; if the deceased signed by thumb print, affidavits of both witnesses are required.      
  • For Letters of Administration with Will annexed - Power of Attorney

The documents required in applying for Letters of Administration include:

  • Original or certified copy of Death Certificate
  • List of assets and liabilities (title documents)
  • Certificate of Valuation (immovable property and vehicles) from the Govt Chief Valuation Officer
  • Oath of Administrator/ix
  • *Certificate (Estate Duty) of proper officer from the Guyana Revenue Authority
  • Administrator's Bond or Consents from Beneficiaries
  • Proof of relationship-Marriage/ Birth certificates, etc.


RESEALING of a Probate or Letters of Administration

A notice of resealing has to be advertised in the Official Gazette of Guyana. The Application to Reseal may be filed two weeks after the said advertisement. The application can be made by a power of attorney duly appointed in Guyana.

The documents required are: 
1. Death Certificate - Certified copy by a Notary Public
2. Certified and true copy of the Probate and Will or Letters of Administration. 
3. List of assets and liabilities (title documents)
4.Certificate of Valuation (immovable property and vehicles) from the Govt Chief Valuation Officer
5. Oath of Administrator/ix
6. *Certificate (Estate Duty) of proper officer from the Guyana Revenue Authority
7. Copy of valid passport page with signature and photo of the applicant

Time - Probate, Letters of Administration and Resealing now takes several months.


*The Estate Duty Certificate is issued by the Guyana Revenue Authority as evidence of payment of estate duty calculated at 0.5% of the gross value of the estate.
